De problematiek rond het beroepsgeheim is meer dan ooit actueel. Een juiste omschrijving ervan blijkt moeilijk. Uit de bestaande wetgeving kunnen we met zekerheid opmaken dat het beroepsgeheim een recht is en een plicht. Dat stelt artikel 458 van het Strafwetboek overduidelijk.Maar waar de scheidingslijn ligt tussen informatierecht en informatieplicht is niet echt duidelijk. Dat blijkt overigens ten overvloede uit de dagelijkse nieuwsberichten. Daar vernemen we hoe met het beroepsgeheim wordt geschermd om bepaalde informatie niet te moeten doorgeven, onder meer in de band- en verzekeringswereld of de gerechtelijke wereld waar het gaat om gegevens over al dan niet zuivere financiële transacties of bezwarende gegevens over personen. Soms heeft de gewone burger de indruk dat het beroepsgeheim een middel is om bepaalde onverkwikkelijke situaties gewoon in de doofpot te stoppen.De op heden geuite kritieken t.a.v. het beroepsgeheim zijn dan ook legio en komen vanuit verschillende hoeken.

Bioethics represents a dramatic revision of the centuries-old professional ethics that governed the behavior of physicians and their relationships with patients. This venerable ethics code was challenged in the years after World War II by the remarkable advances in the biomedical sciences and medicine that raised questions about the definition of death, the use of life-support systems, organ transplantation, and reproductive interventions. This is the first book in healthcare ethics addressing the moral issues regarding ownership of the human body. Modern medicine increasingly transforms the body and makes use of body parts for diagnostic, therapeutic and preventive purposes. The book analyzes the concept of body ownership. It also reviews the ownership issues arising in clinical care (for example, donation policies, autopsy) and biomedical research. Societies and legal systems also have to deal with issues of body ownership. A comparison is made between specific legal arrangements in The Netherlands and France, as examples of legal approaches. In the final section of the book, different theoretical perspectives on the human body are analyzed: libertarian, personalist, deontological and utilitarian theories of body ownership.
